FURY FIGHTING GEAR LLC

Terms of Service

Last updated: October 9, 2026

Welcome to furyfg.com (the "Site"), operated by FURY FIGHTING GEAR LLC ("FURY FIGHTING GEAR," "FURY," "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of the Site and your purchases of our products. Please read them carefully before placing an order.

IMPORTANT: SECTION 14 CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER THAT MAY AFFECT YOUR LEGAL RIGHTS. YOU MAY OPT OUT AS DESCRIBED IN SECTION 14.

1. ELIGIBILITY

You must be at least 18 years old, or the age of majority where you live, to place an order. You must be authorized to use the payment method you provide.

Minors may use our products only with appropriate supervision by a parent, guardian, coach, or other responsible adult.

2. PRODUCTS AND DESCRIPTIONS

We make reasonable efforts to describe and photograph our products accurately.

Product colors may vary depending on your screen. Minor variations in stitching, graphics, texture, finish, dimensions, or packaging may occur as part of normal manufacturing and do not necessarily constitute defects.

Product descriptions, specifications, availability, and pricing may change without notice, subject to applicable law.

3. PRICING, ORDERS, PAYMENTS, AND VERIFICATION

All prices are displayed in U.S. dollars. Applicable taxes will be disclosed at checkout before payment. Standard shipping within the United States is free on all orders, with no minimum purchase.

Placing an order constitutes an offer to purchase. We accept your order when we ship the product. An automated order confirmation or payment authorization does not, by itself, constitute acceptance.

We may reasonably verify, limit, delay, refuse, or cancel an order before shipment due to suspected fraud, payment issues, pricing errors, inventory shortages, inaccurate order information, circumvention of purchase limits, or suspected unauthorized commercial resale.

If an order is canceled after payment has been collected, we will refund the amount charged for the canceled order.

Payments are processed through Stripe. By submitting an order, you authorize us to charge your selected payment method for the total amount disclosed at checkout.

All purchases are one-time transactions. We do not currently offer subscriptions, recurring billing, or automatic renewals.

If you believe your order was canceled or restricted in error, contact support@furyfg.com for assistance.

Order Changes and Cancellations

Customers may request to change or cancel an order before it ships by contacting support@furyfg.com and providing their order number. We will make reasonable efforts to accommodate requests received before shipment, but changes or cancellations cannot be guaranteed once an order has entered fulfillment.

Once an order has shipped, it cannot be canceled or modified through the order process. Eligible products may instead be returned or exchanged in accordance with our Returns, Exchanges & 120-Day Limited Warranty Policy.

If a paid order is successfully canceled before shipment, we will issue a refund to the original payment method. Nothing in this section limits any rights or remedies available under applicable law.

4. SHIPPING, DELIVERY, AND RISK OF LOSS

We ship to addresses within the United States only.

Processing and delivery times are estimates rather than guarantees. You are responsible for providing a complete and accurate shipping address.

To the extent permitted by applicable law, risk of loss passes to you upon delivery to the carrier-confirmed delivery address.

Our Shipping Policy, available on furyfg.com, provides additional information about free U.S. standard shipping, processing times, delivery estimates, tracking, delays, and lost packages.

Nothing in this section limits rights or remedies that cannot legally be excluded.

5. RETURNS, EXCHANGES, AND WARRANTY

Our Returns, Exchanges & 120-Day Limited Warranty Policy, available on furyfg.com, is incorporated into these Terms by reference.

Eligible unused products may be returned or exchanged within 14 days of delivery, subject to that policy.

Our 120-Day Limited Warranty covers qualifying defects in materials and workmanship, beginning on the original purchase date.

The expiration of the 14-day standard return period does not prevent a customer from submitting an eligible manufacturing-defect claim during the 120-day warranty period.

Approved standard returns and exchanges include return shipping at no charge, as described in our policy.

6. BOXING SAFETY WARNINGS AND ASSUMPTION OF RISK

WARNING: BOXING, SPARRING, MARTIAL ARTS, COMBAT SPORTS, AND OTHER REPEATED-IMPACT ACTIVITIES INVOLVE INHERENT RISKS OF SERIOUS INJURY, PERMANENT DISABILITY, AND DEATH.

Participation in these activities is voluntary and involves risks that cannot be eliminated by the use of boxing gloves or other protective equipment.

FURY products are intended for their described training purposes. They are not medical devices, and we do not guarantee that they will prevent or reduce injuries to the hands, wrists, head, or any other part of the body.

Before participating in boxing or other strenuous activities, consult a qualified healthcare professional when appropriate.

You are responsible for using our products appropriately, including:

Products are not warranted for professional competition or sanctioned events unless expressly identified as suitable for that purpose on the applicable product page.

To the fullest extent permitted by law, you voluntarily assume the inherent risks of the sporting and training activities in which you choose to participate.

FURY is not responsible merely because one of its products was being used when an injury occurred.

Nothing in these Terms releases FURY from liability for a defective product, negligence, personal injury, or any other claim to the extent such liability cannot lawfully be waived or limited.

7. 120-DAY LIMITED WARRANTY AND OTHER WARRANTIES

FURY FIGHTING GEAR LLC provides a 120-Day Limited Warranty against qualifying defects in materials and workmanship for eligible products purchased directly from furyfg.com.

The warranty begins on the original date of purchase and is subject to the coverage, exclusions, claim procedures, and remedies in our Returns, Exchanges & 120-Day Limited Warranty Policy.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE 120-DAY PERIOD OF OUR EXPRESS LIMITED WARRANTY.

Some states do not permit limitations on the duration of implied warranties, so this limitation may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights that vary by state.

Nothing in these Terms excludes any warranty, right, remedy, or liability that cannot lawfully be excluded.

8. LIMITATION OF LIABILITY AND EXCLUSIVE REMEDIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FURY FIGHTING GEAR LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM THE SITE, AN ORDER, OR A PRODUCT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY RELATING TO A PARTICULAR PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THAT PRODUCT OR ORDER.

For covered product defects, our remedies are repair, replacement, or refund as described in our Returns, Exchanges & 120-Day Limited Warranty Policy, subject to applicable law.

These limitations do not apply to liability or remedies that cannot legally be limited, including, where applicable, liability for personal injury caused by a defective product.

9. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless FURY FIGHTING GEAR LLC and its members, officers, employees, and agents against third-party claims, losses, damages, liabilities, and reasonable expenses arising from your unlawful or unauthorized misuse of the Site or products, your material violation of these Terms, or your violation of applicable law or third-party rights.

This provision does not require indemnification where prohibited by law.

10. INTELLECTUAL PROPERTY

The FURY FIGHTING GEAR name, logos, product designs, photographs, graphics, text, and other content owned by or licensed to us are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit our protected content without prior written authorization, except as permitted by law.

11. ACCEPTABLE USE, RESELLING, AND SUSPENSION

You agree not to use the Site unlawfully, fraudulently, or in a manner that interferes with its security or operation.

Prohibited conduct includes unauthorized access, malicious software, impersonation, materially false order information, abusive data collection, and automated purchasing intended to circumvent order limits.

Our products are generally sold for personal use. We may reasonably restrict bulk orders or suspected unauthorized commercial resale.

You may not use our branding or product images in a way that falsely suggests sponsorship, affiliation, or authorization.

To the extent permitted by law, we may suspend Site access or refuse future orders when we reasonably believe fraud, misuse, or a material violation of these Terms has occurred.

12. THIRD-PARTY SERVICES

The Site and our business operations depend on third-party providers, including payment processors, hosting providers, backend services, email services, and shipping carriers.

Their services may be subject to separate terms and policies.

To the extent permitted by law, we are not responsible for failures caused solely by third parties outside our reasonable control.

Nothing in this section limits our legal obligations to customers.

13. ELECTRONIC COMMUNICATIONS

By placing an order, you agree to receive electronic communications reasonably necessary to process and support your purchase, including order confirmations, shipping updates, return information, warranty communications, product safety notices, and recalls.

We may also send legally required communications electronically where permitted.

Promotional marketing communications, if offered, will be handled separately and subject to applicable consent and unsubscribe requirements.

14. GOVERNING LAW, ARBITRATION, AND DISPUTE RESOLUTION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS TO BRING CLAIMS IN COURT, HAVE A JURY TRIAL, AND PARTICIPATE IN CLASS ACTIONS.

(a) Governing Law

These Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles, except where another jurisdiction's nonwaivable consumer protections apply.

The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement to the extent applicable.

(b) Informal Dispute Resolution

Before commencing arbitration or litigation, other than an eligible small-claims action or a request for urgent injunctive relief, the complaining party must provide written notice describing the dispute and the relief requested.

Notices to FURY must be sent to support@furyfg.com and should include the customer's name, relevant order number, contact information, and a description of the dispute.

The parties agree to attempt resolution in good faith for 30 days after receipt of the notice.

This process does not require either party to allow a mandatory filing deadline to expire.

(c) Binding Individual Arbitration

If a dispute cannot be resolved informally, you and FURY FIGHTING GEAR LLC agree, to the fullest extent permitted by applicable law, that disputes arising from or relating to these Terms, the Site, a product, or a purchase will be resolved through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules.

Information about the AAA and its rules is available at adr.org.

Arbitration may occur by telephone, video conference, written submissions, or in person, consistent with applicable rules and law.

Any in-person hearing will occur in the customer's county of residence or another location mutually agreed upon, subject to applicable law and AAA rules.

Arbitration fees and costs will be allocated in accordance with the applicable AAA Consumer Arbitration Rules and law.

Judgment on an arbitration award may be entered in a court of competent jurisdiction.

(d) Exceptions

Either party may bring an individual claim in small-claims court if the claim qualifies and remains within that court's jurisdiction.

Either party may seek appropriate injunctive relief in court concerning infringement or misuse of intellectual property.

Claims that cannot legally be required to proceed through arbitration are excluded to the extent required by law.

(e) Class-Action and Jury-Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FURY EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION.

TO THE EXTENT PERMITTED BY LAW, YOU AND FURY ALSO WAIVE THE RIGHT TO A JURY TRIAL FOR CLAIMS SUBJECT TO THIS AGREEMENT.

An arbitrator may award relief only to the individual party seeking relief, except where applicable law requires otherwise.

If the class-action waiver is found unenforceable with respect to a particular claim and that claim cannot lawfully proceed in individual arbitration, that claim will proceed in a court of competent jurisdiction rather than class arbitration, to the extent permitted by law.

(f) 30-Day Right to Opt Out

You may opt out of the arbitration agreement and class-action waiver by emailing support@furyfg.com within 30 days of your first purchase.

Use the subject line "Arbitration Opt-Out" and include your full name and order number.

Timely opting out will not affect your purchase, warranty coverage, or any other provision of these Terms.

(g) Survival

This section survives completion of a purchase and termination of these Terms, to the extent permitted by law.

15. CHANGES AND SEVERABILITY

We may update these Terms periodically.

The version presented or made available when you place an order generally governs that purchase, unless applicable law requires otherwise.

If a provision is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law, subject to any specific severability requirements in Section 14.

Our failure to enforce a provision does not waive our right to enforce it later.

16. TAXES

Customers are responsible for applicable sales, use, and similar taxes.

We collect taxes where required by law and disclose applicable amounts at checkout.

17. REVIEWS AND CUSTOMER SUBMISSIONS

If you submit a review, photograph, testimonial, or other content, you represent that you have the right to share it and that any factual statements about your experience are truthful.

You grant FURY a nonexclusive, worldwide, royalty-free license to use and display submitted content in connection with our business, subject to applicable law and privacy rights.

We do not fabricate reviews or remove reviews merely because they are negative.

We may moderate or remove submissions that are unlawful, abusive, infringing, deceptive, or unrelated to our products or services.

18. ACCESSIBILITY

We aim to make furyfg.com reasonably accessible.

If you experience difficulty accessing the Site or completing a purchase, please contact support@furyfg.com so we can provide reasonable assistance.

19. EVENTS OUTSIDE OUR CONTROL AND GENERAL TERMS

To the extent permitted by law, we are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disputes, supply-chain interruptions, government actions, or third-party service failures.

You may not assign these Terms without our consent. We may assign them in connection with a lawful sale, merger, or reorganization of our business.

Notices to customers may be sent to the email address associated with their order.

20. PAYMENT DISPUTES, FRAUD, AND ABUSE

If you experience a problem with an order, we encourage you to contact support@furyfg.com before initiating a payment dispute, provided doing so does not interfere with any legal or payment-network rights or deadlines.

We may investigate and contest fraudulent, false, duplicative, or abusive payment disputes using relevant records, including payment information, order details, shipping tracking, delivery confirmation, photographs, and customer communications.

To the extent permitted by law and payment-network rules, we may refuse future orders associated with reasonably documented fraud or abuse.

Nothing in this section prevents you from exercising lawful chargeback or consumer-protection rights.

21. TIME LIMIT TO BRING CLAIMS

TO THE EXTENT PERMITTED BY APPLICABLE LAW, A CLAIM RELATING TO THE SITE, AN ORDER, OR A PRODUCT MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES.

This provision does not shorten any limitation period that applicable law prohibits parties from shortening.

22. ACCEPTANCE OF TERMS; RETENTION AND USE OF PRODUCTS

By affirmatively accepting these Terms during checkout, you agree to be bound by them, including the individual arbitration agreement and class-action waiver in Section 14, unless you validly opt out.

If you receive a product and do not agree to these Terms, you may request a return within 14 days of delivery, subject to our Returns Policy and applicable law.

To the fullest extent permitted by law, retaining or using a product after receiving clear notice of these Terms and a reasonable opportunity to review and reject them may constitute additional evidence of acceptance.

Retention or use alone does not establish consent where affirmative agreement is required by law.

Nothing in this section limits nonwaivable consumer rights or remedies.

23. ENTIRE AGREEMENT AND ELECTRONIC ACCEPTANCE

These Terms, together with our Privacy Policy, Shipping Policy, Returns, Exchanges & 120-Day Limited Warranty Policy, and any additional terms expressly presented with an applicable product or offer, constitute the agreement governing the Site and purchases from FURY.

These documents supersede prior statements concerning the same subject, except where applicable law provides otherwise.

When checkout presents these Terms and requires affirmative agreement, your electronic acceptance constitutes your agreement to them.

No employee or representative may modify these Terms except through an authorized written modification.

24. COACHES, TRAINERS, GYMS, SCHOOLS, AND GROUP USE

If you purchase or provide FURY products for use by others as a coach, trainer, gym, school, team, or similar organization, you agree to take reasonable steps to:

You may not make unauthorized warranties, medical claims, or injury-prevention claims on behalf of FURY.

To the extent permitted by law, you agree to indemnify and hold harmless FURY from third-party claims arising from your negligent supervision, improper instruction, product misuse, failure to inspect equipment, or unauthorized representations, except to the extent the claim arises from conduct for which FURY cannot lawfully transfer responsibility.

25. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes are subject to the terms displayed with each offer.

Unless otherwise stated, only one promotional code may be used per order, codes cannot be combined, codes have no cash value, and discounts cannot be applied retroactively.

Promotional exclusions, expiration dates, and restrictions will be disclosed with the applicable offer.

Refunds for discounted merchandise are generally based on the amount actually paid, subject to applicable law.

We may correct promotional errors or restrict fraudulent use of discounts, subject to applicable law.

26. PRODUCT SAFETY NOTICES AND RECALLS

If we issue a product safety notice or recall, stop using the affected product and follow the applicable instructions.

We may contact customers using the information associated with their orders when reasonably necessary to provide product safety notices, recall information, or corrective actions.

We may also publish relevant safety notices on furyfg.com.

27. CALIFORNIA PROPOSITION 65

California Proposition 65 may require product-specific warnings for certain exposures to listed chemicals.

Where a warning is required for a FURY product, we will provide the applicable warning on the relevant product page before purchase and on or with the product as required by law.

This general notice does not replace any product-specific warning that may be legally required.

Additional information is available at www.P65Warnings.ca.gov.
